Pre-Production Activities

Owner acknowledges that Purchaser may, during the Option Period, undertake pre-production activities in connection with any of the rights to be acquired hereunder, including, without limitation, the preparation and submission of treatments and screenplays based on the Property, and all such materials prepared by Purchaser, shall from their inception belong to Purchaser, whether or not the Option is exercised.

Commentary

Developing a film or TV production entails creating a variety of additional materials (such as treatments and screenplays) to assess the viability of the project and the best way for the Producer to tell the story in this format. This provision authorizes the creation of the developmental documents (including, without limitation, a screenplay) as part of this process and provides that these documents will belong to the Purchaser whether or not the Option is exercised.
