Property

The Property consists of the literary work ____________  and includes any and all plots, themes, titles, stories, sequences, incidents, ideas, characters, characterizations, costumes, literary, dramatic and musical material contained therein, together with all adaptations, dramatizations, translations, revisions, additions and other versions thereof now existing or hereafter created, all copyrights and renewals and extensions of copyright thereto and all other rights and interests pertaining thereto.

This paragraph defines precisely what work is being optioned. Please read this language carefully, since the Property as defined in the model includes more than the written work as a whole; it includes characters and themes and other story and literary elements, as well as adaptations and dramatizations of the literary work. If there are elements of the literary work that the Owner does not wish to option, these should be carved out of the option agreement.
