Copyright.

The Publisher agrees to register the copyright in the Translation in the name of the Translator with the U.S. Copyright Office within three months of initial publication. The Publisher agrees to print the following copyright notice in the Translator's name in each copy of the Translation published under this Agreement and will require each of its sub-licensees to do the same:

English Translation Copyright © [year of publication] [Translator Name]

Commentary

It is important and customary for the publisher of the translation to register the copyright in the translation in the name of the translator within three months of initial publication. Timely registration guarantees that the translator will be entitled to seek statutory damages and attorney's fees if the translation is infringed. Without timely registration, the translator would be entitled to seek actual damages only, which may be considerably less and would not include attorney's fees.
